What types of CRPS lawsuits can I file?
There are different types of CRPS lawsuits. We can explain which type of lawsuit you have during our initial consultation. The types of lawsuits are:
- Personal injury lawsuits. You can file a personal injury claim if someone owes you a duty of care, breaches that duty, and the breach causes your injuries (such as CRPS). A common example is if a driver speeds and rear-ends your car. Drivers owe everyone on the road a duty to drive safely. Speeding is a breach of that duty. If the speeding driver rear-ends your car and injures you, causing your CRPS, then you have a personal injury claim.
- Medical malpractice lawsuits. These lawsuits are a special type of personal injury claim. The medical provider, such as a doctor, owes you a duty of competent medical care. If they breach that care (for example, by delaying your diagnosis) and the breach causes your CRPS, then you have a medical malpractice claim.
- A product liability claim. This type of claim occurs when manufacturers make products that are defective. If the defective product causes your CRPS, then you have a product liability claim. Anyone who suffers injuries due to defective products, including employees, should speak to a lawyer about filing a product liability claim.
- Workplace accident lawsuits. Independent contractors may be able to file personal injury claims against the people they work for.
Two other types of lawsuits, that provide some compensation, but not nearly as much as a personal injury claim, are the following:
- Workers’ compensation lawsuits. Employees can file a workers’ compensation claim against their employer if they suffer a workplace injury during the scope of their employment.
- Social Security Injury (SSI) and Social Security Disability Insurance (SSDI) claims. If your CRPS prevents you from working for at least one year, you may also be able to file an SSI/SSDI claim.
How much time do I have to file a CRPS lawsuit?
The deadlines (called statutes of limitations) vary depending on the type of case and the state in which you are filing your claim. Many states have a two-year statute of limitations for a personal injury case, but the time limit can be just one year, or you might have more time to file. Note that there are often much shorter deadlines if you have a claim against a governmental agency. There may also be differences based on how your injury occurred. Some states have different statutes of limitations for personal injury claims than for medical malpractice claims, for instance.

Where do you file a CRPS lawsuit?
